<p>A new Tennessee DUI law has gone into effect and as of January 1st police at traffic stops can now force blood tests on prior DUI offenders, as opposed to giving them the option under implied consent.</p>
<p>&#8220;Police can pull someone over for not wearing their seatbelts and then notice the smell of alcohol or the bloodshot eyes, it&#8217;s not something you have to know before you pull them over that they&#8217;re drunk,&#8221; says Kate Lavery from the District Attorney&#8217;s office.</p>
<p>&#8220;Before January 1st, all we could do was to remove their license which might have already been removed so this will help us deal with the problem of multiple offender DUI&#8217;s,&#8221; says Lavery.</p>
<p>Others, however, who have been convicted of DUI in the past, feel the law is unfair; that it violates their rights as citizens. One of them, David C., spoke up on the matter:</p>
<p>&#8220;I think people who have made mistakes with DUI in the past still has rights and they certainly have to pay the consequences, but it seems a little bit to far,&#8221; says David.</p>

			<content:encoded><![CDATA[<p>The president of the New York Public Library has been arrested on drunken driving charges after he backed into a parked car in upper Manhattan.</p>
<p>Police say 52-year-old Anthony Marx was arrested Sunday. He pleaded not guilty to aggravated driving while intoxicated at his arraignment Monday and released on his own recognizance. He&#8217;s due back in court Dec. 9.</p>
<p>The New York Times says Marx&#8217;s blood-alcohol level at the time of his arrest was tested at 0.19 percent, more than twice the legal limit. The paper says Marx released a statement through a library spokeswoman saying he deeply regrets the embarrassment caused to his family and the library.</p>
<p>Marx is the former president of Amherst College and a Bronx High School of Science graduate. He joined the library in July.</p>

			<content:encoded><![CDATA[<p>Rodney King has pleaded not guilty to charges of driving under the influence stemming from his arrest in Southern California in July.</p>
<p>Online court records show King entered the plea Monday in Superior Court in Riverside to misdemeanor counts of driving under the influence and driving with a blood-alcohol content above the legal limit.</p>
<p>King&#8217;s next hearing is Nov. 21. His lawyer Laura Box did not return a phone message seeking comment.</p>
<p>Prosecutors have said King was driving under the influence of alcohol and marijuana when he was pulled over in Moreno Valley. If convicted, he could face up to a year in jail because of a prior DUI conviction.</p>
<p>King, who is black, was beaten by four white officers in 1991. A year later, the officers&#8217; acquittals in the beating sparked days of rioting that killed 55 people.</p>

<p>He was arrested Aug. 5 for driving under the influence in Hanson County. The arrest came three days after he pleaded guilty to driving with a revoked license, a charge that stemmed from a DUI conviction last December.</p>
<p>He did not immediately respond to an Associated Press request for comment on Wednesday.</p>

			<content:encoded><![CDATA[<p>An attorney and Wayne State University professor are disputing how a Michigan  judge sentences first-time drunken driving offenders.</p>
<p>A motion to disqualify was recently filed against Judge Kimberly Small in 48th District Court.</p>
<p>“Her recent announcements in regard to her sentencing indicate she may be violating due process rules under the state and federal constitutions,” said attorney Robert Larin, a former county and federal prosecutor.</p>
<p>Small unofficially was labeled as being the toughest in the state on people guilty of drunken driving. The brand on her reputation came just before she <a href="http://www.drunkdrivingduilawblog.com/michigan-dui-law/jalen-rose-begins-20-day-jail-sentence-for-dui/">sentenced former University of Michigan and NBA basketball player Jalen Rose to 20 days in jail</a>.</p>
<p>Rose, who now works as an NBA analyst for ESPN, is serving that time in the Oakland County Jail after having pleaded guilty to a misdemeanor charge of operating a vehicle while intoxicated.</p>
<p>Small declined to comment on the motion, citing it as an open case.</p>
<p>Small in an interview said she has no way to accurately gauge if she is indeed the toughest in Michigan on drunken drivers. While Small said she looks at each case individually, she also stated she doesn’t “tolerate drunk drivers.”</p>
<p>The statements Small made in interviews show she is possibly interfering with the legislative arm of the government, Larin said.</p>
<p>Between 80 and 85 percent of first-time offenders are convicted of a reduced charge, he said.<br />

“These cases are a minimum of zero days and a max of 93 days,” said Larin, adding Small is refusing “to follow state law.”</p>
<p>Before filing the motion, Larin said he had it reviewed by Kenneth Mogill, a professor at Wayne State University.</p>
<p>“When we did the research, and he did most of it, it was determined she should be disqualified from hearing first-offense cases,” he said. “Some of her statements and actions would indicate … she may not be exercising proper discretion.”</p>
<p>The public online debated Small’s reputation and how motorists convicted of drunken driving should be treated following the news of the motion.</p>
<p>One person using the name BigBoss wrote he doesn’t approve of what Small is doing.</p>
<p>“She is doing a bad job,” he said. “She needs to start putting harsher fines on real crimes like dope dealing. That’s a much bigger problem.”</p>
<p>Another reader, using the name michiganretiree, wrote about a family member’s struggle with alcohol.</p>
<p>“I had a son who had a drunk-driving problem about 15 years ago, and he always said if he would have gotten more jail time in the beginning it would have deterred him. He felt the system needed to change,” the person wrote. “Good for this judge.”</p>
<p>A person using the name Wolverine 1 wrote each case should be treated differently.</p>
<p>“I think in some cases jail time for a first offense may be warranted, but certainly not in every case,” he said. “Mandatory jail time for a first offense is too severe. Our jails are too overcrowded and costing us taxpayers too much money.</p>
<p>“I think this judge is out of control.”</p>

			<content:encoded><![CDATA[<p>A California citizens group says local law enforcement is using DUI checkpoints for more than just getting drivers under the influence off the road.</p>
<p>As it stands today, checkpoints in California remain unregulated. Police agencies are asked to follow guidelines set forth in a 1987 decision by the California Supreme Court, but they&#8217;re not required to follow them.</p>
<p>On Wednesday, the Equality Alliance held a news conference in front of the office of state Sen. Christine Kehoe, calling on her to support a proposed new law that would strictly regulate the checkpoints to be for DUI checking only. The bill comes before the Appropriations Committee, which Kehoe heads, on Monday.</p>
<p>A Kehoe representative told 10News the senator won&#8217;t take a position on the bill until after it comes before her committee.</p>
<p>&#8220;People from all walks of life, all colors and stripes complained of harassment, complained of discrimination, complained of inconvenience and invasion of privacy,&#8221; said Andrea Guerrero, executive director of Equality Alliance.</p>
<p>Guerrero pointed to results of a survey done by Equality Alliance between late May and mid-June of this year. It found that 64 percent of people questioned are opposed to checkpoints.<br />

Guerrero said it would be better if police agencies in San Diego conducted their checkpoints like the Los Angeles Police Department does.</p>
<p>&#8220;They run checkpoints with advance notice to the population; 48 hours notice,&#8221; Guerrero said.</p>
<p>The Escondido Police Department has been the target of criticism over its checkpoints, primarily from the city&#8217;s minority community. They&#8217;ve faced charges of discrimination from members of the city&#8217;s Hispanic community.</p>
<p>Escondido police Lt. Tom Albergo rejected the criticism and told 10News the police department does not target any specific community or neighborhoods, and it follows the 1987 suggestions from the state supreme court.</p>
<p>10News asked Albergo why Escondido doesn&#8217;t conduct its checkpoints the way the LAPD does, and Albergo said, &#8220;It seems to me that if I tell drunk drivers or people that might be out drinking where we&#8217;re going to be, then where&#8217;s the deterrent affect for the rest of the community?&#8221;</p>
<p>Albergo also said that whatever the legislature decides is what Escondido police will comply with.</p>

<p>Tougher penalties and avenues for treatment are part of a package of DUI laws enacted by Delaware Governor Jack Markell.</p>
<p>Markell, state legislators and law enforcement officials stood in  front of the wreckage of a car involved in a fatal DUI accident for the  bill-signing at the Minquas Fire Company in Newport.</p>
<p>“These bills accomplish several things,” Markell said.  “They  increase the penalties for repeat offenders.  They provide more  substance abuse treatment for people who need it.  They provide better  and more efficient use of our limited resources.  And, above all, they  make our roads safer.”</p>
<p>One law targets repeat offenders in particular, those who have been  arrested multiple times for driving under the influence.  Anyone found  guilty of a second DUI offense within a ten-year period would be subject  to enhanced penalties of up to 60 days in jail.  A third offense could  result in a three-month term, and a fourth conviction could lead to six  months behind bars, with further stepwise increases.  The court may  suspend up to half of the minimum sentence for offenders while requiring  the offender to take part in an intensive treatment program.   Requirements would include abstinence from alcohol for at least 90 days  and the wearing of a monitoring device that can detect alcohol use.<br />

“Yes, we can lock people up and throw away the key.  But, unless we cure  and start to have a conversation with the individuals about the root  cause of why they’re getting behind the wheel, it doesn’t solve  anything”, said State Representative Helene Keeley (D-Wilmington), the  prime sponsor of the bill in the House.</p>
<p>“We believe mandatory treatment works, and it’s been proven that  mandatory treatment works,” added State Senator Patricia Blevins  (D-Elsmere), the other chief sponsor.</p>
<p>A second new law in Delaware establishes the crime of third-degree  vehicular assault, which covers cases where someone driving with  criminal negligence causes injury to another person.  It also carries  stronger criminal penalties for crimes including second-degree vehicular  assault, second-and first-degree vehicular homicide, and criminally  negligent homicide.</p>
<p>Attorney General Beau Biden said 38 percent of Delaware’s 103 highway  fatalities in 2010 were alcohol related.  Biden also recognized the  importance of a treatment option for those who want to help themselves.   He also added the state will get tougher on repeat offenders and “put  them behind bars when they decide to get behind the wheel of what  becomes a lethal weapon on the streets of our state.”</p>
